These Terms of Service ("Terms") govern your use of the RIGLINK fleet management platform, including the RIGLINK Dispatch Console and the RIGLINK Driver mobile application (collectively, the "Services"), operated by RIGLINK ("we", "our", or "us"). By accessing or using the Services you agree to be bound by these Terms.
1. Access and accounts
Access to the Services is granted by your employer or haulage company ("your company"), which enters into a separate agreement with RIGLINK governing their use of the platform. Individual driver and dispatcher accounts are created by your company administrator.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. If you believe your account has been compromised, notify your company administrator immediately.
2. Permitted use
You may use the Services only for lawful purposes and in connection with your employment duties. You must not:
- Use the Services to transmit any unlawful, harmful, or fraudulent content.
- Attempt to gain unauthorised access to any part of the Services or related systems.
- Reverse engineer, decompile, or disassemble any part of the Services.
- Use automated tools to access or scrape the Services without our written consent.
- Interfere with the integrity or performance of the Services.
3. Location data
By using the RIGLINK Driver app during working hours, you consent to the collection and transmission of your GPS location to your employer through the RIGLINK platform. Location tracking is active only while the app is in use. Your employer is responsible for informing you of their specific monitoring policies in accordance with applicable employment law.
4. Uploaded content
You retain ownership of any documents, images, and data you upload through the Services. By uploading content you grant RIGLINK a limited licence to store, process, and display that content solely for the purpose of providing the Services to you and your employer.
You are responsible for ensuring that any content you upload does not infringe the rights of any third party and complies with applicable law.
5. Intellectual property
The Services, including all software, design, trademarks, and content produced by RIGLINK, are owned by or licensed to RIGLINK. Nothing in these Terms grants you any right to use the RIGLINK name, logo, or other brand features without our prior written consent.
6. Availability and changes
We aim to keep the Services available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.
We may update these Terms from time to time. We will notify company administrators of material changes. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free or that any defects will be corrected.
8. Limitation of liability
To the fullest extent permitted by law, RIGLINK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by your company to RIGLINK in the three months preceding the claim.
9. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or at the request of your company administrator. Upon termination, your right to use the Services ceases immediately.
10. Governing law
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
